Abstract

This research deals with an objective study of the comparative jurisprudence approach of Sayyid al-Sharif al-Murtada, one of the leaders of Islamic thought in the Abbasid era, where it sheds light on his scientific efforts in discussing jurisprudential issues from a comparative perspective that combines transmission and reason. The research was divided into two main sections: The first dealt with the theoretical framework, with an introduction to al-Sharif al-Murtada in terms of his name, lineage, scientific and social biography, with a statement of his influence in the jurisprudential field through his teachers, students and writings. As for the second section, it included an applied study of two jurisprudential issues, which are: washing the hands and wiping the feet in ablution, where the opinions of the four schools (Hanafi, Maliki, Shafi'i, Hanbali) were presented regarding these two issues, then compared in detail with the opinion of al-Sharif al-Murtada, with an analysis of his jurisprudential approach that shows his distinction in reasoning and authentication. The research aims to highlight the position of Al-Sharif Al-Murtada in comparative jurisprudence, and to clarify the importance of studying this type of jurisprudence as a means of rapprochement between Islamic sects and enhancing constructive dialogue between them.
