The Importance of Islamic Jurisprudence and Legal Rules in Regulating the Family and the Effects of Cultural Invasion on It

Abstract

The family is by nature a social entity, incapable of living in isolation but rather in communion. It is the primary social unit, and from families, the clan and then the community are formed. This family structure has undergone changes that necessitated its regulation. Initially, this regulation took the form of customs recognized by the community. Later, some of these customs were codified and formally formulated into binding legal rules. Following the revelation of the Prophet Muhammad's message, Islamic jurisprudence emerged, deriving its rulings from the Holy Quran, the Prophetic Sunnah, and the jurisprudence of the Ahlul-Bayt (peace be upon them). This jurisprudence meticulously regulated family affairs in accordance with human nature Today, in light of rapid technological advancements, intellectual and cultural invasions, and the soft warfare targeting Muslim societies—which has a more profound impact on humanity than military conflicts—we are in dire need of rules and laws that align with the principles of Islamic jurisprudence derived from the Holy Quran, whose rules are applicable to all times and places. Islamic jurisprudence clarifies that humanity possesses two dimensions: an existential dimension and an intellectual dimension. After societal realities became harsh, marked by increased crime, family disintegration, and a rapid shift in ideas, values, and principles—due to a hybrid cultural invasion alien to Islamic thought—a significant gap and vast difference in perspectives emerged between parents and children. This intellectual divergence has more negative than positive effects on both generations, most notably the loss of security and family stability .
